Terms and Conditions

These Terms and Conditions outline the relationship between Why Not Roam LLC, doing business as Why Not Roam Travel Club (“AGENCY”), and you, the traveler or website user (“Client”). By booking travel through AGENCY, you agree to these terms. AGENCY serves solely as a booking agent for disclosed suppliers, including tour operators, cruise lines, hotels, airlines, transportation providers, and other independent contractors (“Supplier(s)”), and is not the provider of these travel services. These terms include important disclaimers, liability limitations, and warranty exclusions that may affect your rights while protecting AGENCY.

 

USE OF AGENCY SERVICES, ACCESS AND INFORMATION FOR TRAVEL BOOKINGS

 

By using AGENCY’s services, you confirm that you are at least 18 years old and have the legal authority to enter into this Agreement and make travel bookings. You accept financial responsibility for all bookings made on your behalf and for your travel party and confirm that all information provided by you or your representatives is accurate and truthful.  AGENCY acts as an agent for the travel Suppliers listed in your itinerary. Each Supplier has its own terms and conditions, which will govern your reservations and purchases. By booking with AGENCY, you agree to adhere to the terms set forth by the Suppliers you select. AGENCY operates as an independent contractor of WorldVia Travel Network.

 

PAYMENTS AND CANCELLATIONS

 

You are fully responsible for all charges, fees, taxes, and assessments related to your travel bookings through AGENCY. By submitting a credit card authorization form, you authorize AGENCY to use your payment method to purchase travel products from our Suppliers on your behalf. Except in cases of fraud, you agree not to dispute these charges with your bank or credit card company in violation of the booking terms and conditions, including cancellations or itinerary changes outside of AGENCY’s or its suppliers’ control. If you initiate a chargeback or payment reversal, AGENCY reserves the right to recover any associated costs, including attorney fees.

Payment is due in full prior to departure, according to each Supplier’s terms and conditions. Failure to make payment or adhere to these terms may result in cancellation of your reservations and the forfeiture of any payments made. Some bookings may be non-refundable once confirmed or under deposit. You may not be entitled to a refund if you change or cancel your plans after confirmation. All cancellations must be submitted in writing to AGENCY, and third-party Supplier cancellation penalties will apply. Cancellation fees will be charged to your payment method or deducted from any Supplier refunds.

 

TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS

 

It is the Client’s responsibility to obtain and carry a valid passport, visa(s), and any other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and Department of Homeland Security (DHS) recommend carrying acceptable identification to board your flight. Acceptable IDs can be found at TSA ID Requirements and include DHS-designated enhanced driver’s licenses, passports, and foreign government-issued passports. The name, date of birth, and gender on your ID must exactly match the information on your airline ticket and booking records. Failure to comply may result in denied boarding or delays at airport security, potentially causing you to miss flights or other scheduled travel bookings.

Upon receiving travel documents, you must review and verify all information for accuracy. Contact AGENCY immediately if any corrections are needed.  Be aware that some countries will not admit passengers if their passport is set to expire within six months of the return date. Non-U.S. citizens may need additional documentation. If traveling on a passport from a country other than the United States, you must inform AGENCY. AGENCY does not control or guarantee the issuance of visas or visa waivers. If a visa is not issued, AGENCY is not responsible for any lost payments related to the trip. Entry and exit rules can change frequently. Children and infants also require travel documents. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

 

While we, out of respect for client privacy, do not inquire about criminal records, each country has its own policies for evaluating past criminal offenses, both domestic and international. For example, individuals with a Driving While Intoxicated (DWI) conviction traveling to or through Canada should review the current entry requirements at Canada’s Immigration Inadmissibility Information.  If you have a criminal record, contact the relevant country directly for their specific entry and exit requirements prior to booking travel. HAZARDOUS MATERIALS

  • Federal law prohibits passengers from bringing hazardous materials on the aircraft.
    Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.
  • There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. INSECTICIDE NOTICE

 

Refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. HEALTH/IMMUNIZATIONS

 

Certain immunizations and health screenings may be required before travel. AGENCY is not responsible for verifying the accuracy of your health, vaccination, or documentation either before departure or upon arrival at your destination. In some cases, required vaccinations must be recorded on a valid vaccination certificate by your healthcare provider, which you must carry as proof of inoculation. If you have concerns about medications or vaccinations, consult your healthcare provider before booking. AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN

 

AGENCY is not responsible for any changes to air schedules. In some cases, departure taxes may need to be paid in cash upon leaving a country, and these taxes can vary in price. Failure to use a reservation may result in automatic cancellation of all subsequent and return flights, as well as forfeiture of airfare. Airline e-tickets expire one year from the issue date, unless the carrier’s fare rules specify otherwise. For enhanced security, it is recommended to check in at least 2 hours before domestic flights and 3 hours before international flights. Please reconfirm flight times at least 24 hours prior to departure for domestic flights and 72 hours prior for international flights.

 

RIGHT TO CORRECT ERRORS/OFFERS SUBJECT TO AVAILABILITY

 

We reserve the right to correct any errors, including pricing mistakes or omissions, and adjust pricing as needed. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. We recommend booking early to avoid fare increases and late booking fees.

 

UNUSED ARRANGEMENTS, MINIMUM PASSENGER REQUIREMENTS AND ALTERATIONS TO BOOKINGS

 

No refunds will be issued for unused portions of tours, cruises, or packages based on Suppliers’ contract rates. Some group tours require a minimum number of passengers; if this minimum is not met, a surcharge may apply or the tour may be canceled. Cancellations due to insufficient passenger numbers will follow the tour operator’s cancellation policy. If you wish to change any confirmed arrangements before departure or during your trip, we will try to assist you, though some bookings may be non-changeable. All change requests must be submitted in writing to AGENCY. Suppliers may alter itineraries for reasons such as severe weather. Any itinerary changes are at the Supplier’s discretion, and AGENCY is not responsible for these modifications.

 

LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE

 

AGENCY acts solely as a booking agent for disclosed principal Suppliers and is not the provider of any travel services. Each Supplier is an independent entity with its own management and operations, separate from AGENCY’s control. The Suppliers listed in your travel documentation are responsible for providing the services, and you consent to using those Suppliers.  Since AGENCY does not control the operations of these independent Suppliers, you agree that AGENCY is not liable for any personal injury or property damage arising from their services. AGENCY disclaims all liability, whether based on contract, tort, or otherwise, including but not limited to direct, punitive, special, consequential, incidental, or indirect damages. This includes liability for any acts, errors, omissions, injuries, losses, accidents, delays, or irregularities caused by the Supplier or their employees, agents, or representatives. This also covers issues such as failure to deliver services, cancellations, refund policies, fuel increases, bankruptcy, or cessation of operations—matters outside AGENCY’s control. You agree to hold AGENCY harmless from any liability related to these circumstances.

 

RISKS & SAFETY

 

Travel to certain destinations may involve increased risks. AGENCY encourages Clients to stay informed by reviewing current news and travel advisories issued by the U.S. Government before booking international travel. Information on health, safety, and travel risks is available at state.gov, tsa.gov, dot.gov, faa.gov, cdc.gov, and cbp.gov. Clients are also encouraged to register for the free Smart Traveler Enrollment Program (STEP) at step.state.gov, which assists U.S. citizens traveling or living abroad in case of emergencies.  By offering travel to certain destinations, AGENCY does not guarantee that travel to those locations is safe or advisable and is not liable for costs, damages, or losses resulting from such travel. Clients assume all risks associated with their travel. In cases of emergent health or safety concerns, AGENCY reserves the sole discretion to proceed with or alter any escorted trip or private departure itinerary after assessing the situation.

 

FORCE MAJEURE

 

AGENCY is not liable for any failure or delay in fulfilling its obligations under these terms due to causes beyond its reasonable control, including but not limited to: acts of God, accidents, riots, war, terrorism, epidemics, pandemics, quarantines, civil disturbances, communication failures (e.g., web hosting or internet outages), equipment malfunctions, natural disasters (e.g., extreme weather, floods, volcanic eruptions), governmental actions, legal changes, national strikes, fires, explosions, or shortages of raw materials or energy. Clients are strongly encouraged to purchase travel insurance for all trips.  Each Supplier’s terms and conditions also include Force Majeure provisions. If such an event occurs, Suppliers may, at their sole discretion, modify, postpone, or cancel itineraries or arrangements. Any refund resulting from non-performance will be subject to the Supplier’s policies. AGENCY will make reasonable efforts to assist in securing refunds where possible but cannot guarantee reimbursement.

 

CLIENT CONDUCT

 

Participants on trips organized by AGENCY are expected to behave responsibly and adhere to guidelines provided by AGENCY and its Suppliers. AGENCY and Suppliers reserve the right to remove any traveler whose behavior or health poses a risk to themselves or others, disrupts fellow travelers, or interferes with operations. In such cases, no refunds will be issued.  By booking with AGENCY, you accept responsibility for any damage or loss caused by you and agree to pay directly to the affected property owner, manager, or Supplier. You also agree to indemnify and hold AGENCY harmless from any claims, including legal expenses, resulting from your actions. AGENCY is not liable for any costs incurred due to a traveler’s removal from a trip. Additionally, baggage and personal belongings remain the traveler’s sole responsibility at all times.

 

CURRENCY FLUCTUATIONS

 

Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations. AGENCY is not responsible for surcharges or foreign transaction fees imposed by Client’s credit card or bank.

 

TRAVEL INSURANCE

 

AGENCY strongly recommends purchasing travel insurance to protect your travel investment. Coverage options include, but are not limited to, supplier default or bankruptcy, trip delays, cancellations, interruptions, missed cruise connections, medical emergencies, evacuation and repatriation, baggage loss or delay, illness, job loss, accidental death or disability, and other unforeseen events.  While travel insurance is optional, clients who decline coverage must sign a waiver accepting full responsibility for any losses incurred. AGENCY is not a licensed insurance broker and cannot guarantee that an insurance provider will approve claims or specify the extent of coverage under any offered policy.

 

RESERVATION OF RIGHTS: CHANGES TO THESE TERMS

 

AGENCY reserves the right to modify these Terms and Conditions at any time, at its sole discretion. Updated versions will be posted on our website and will take effect immediately upon publication.

 

GENERAL

 

These Terms and Conditions are governed by the laws of the State of Georgia. By booking with AGENCY, you consent to the exclusive jurisdiction and venue of courts located in Georgia for any disputes arising from or related to your travel booking.  If any provision of these Terms and Conditions is found to be invalid or unenforceable under applicable law, including warranty disclaimers and liability limitations, the invalid provision will be replaced by a valid provision that most closely reflects its original intent. The remaining provisions will remain in effect.  These Terms and Conditions represent the entire agreement between the Client and AGENCY. A printed version of this agreement, along with any electronic notices, is admissible in judicial or administrative proceedings to the same extent as other business documents originally created and maintained in printed form.
